TERMS & CONDITIONS

GENERAL

These terms of service (the “Terms of Service”) are a legally binding agreement between ΧΡΥΣΟΧΟΕΙΟΝ Χ. ΣΠΑΝΟΣ ΛΙΜΙΤΕΔ (“SPANOS JEWELLERY” or “we”, “our”, “us”), a company registered in the Republic of Cyprus, with registration number HE50925 and having its registered office at Strovolou, 145Β, Strovolos, 2042, Nicosia, Cyprus and the person agreeing to the terms herein (“you” or “user”).

The Terms of Service will be effective as of the date you accept them as part of the registration process. Potential customers who do not agree with the Terms of Service should refrain from accepting them.

We may amend these Terms of Service from time to time by posting the updated version of the Terms of Service in our website. In order to ensure that you are up to date with the most current version of the Terms of Service, you are required to check a box confirming that you have read and agreed our Terms of Service before proceeding with your order.

USER ACCOUNT

In order to create a user account:

• each user is required to register by completing the registration form;
• the user must provide accurate information in the registration form, namely a full legal name and a valid email address, in order to complete the registration form;
• the user must be at least 18 years old; and
• the user must be a consumer.

APPROPRIATE USE

You may only use the website in accordance with our Terms of Service and subject to all laws and regulations of the Republic of Cyprus. You agree that you shall not:

1. use the website for any illegal or unauthorized purpose;
2. share your login information (username and password);
3. share a single login with multiple people; 
4. use the website for any commercial or competitive activity or purpose unless you have our written permission; 
5. access, monitor or copy any content or information of the website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
6. take any action that imposes, or may impose, at our discretion, an unreasonable or disproportionately large load on our infrastructure;
7. upload, post, host or transmit unsolicited email, SMS messages or “spam” messages;
8. transmit any worms or viruses or any code of a destructive nature;
9. “frame”, “mirror” or otherwise incorporate any part of the website into any other website or application without our prior written authorization; or
10. attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by us in connection with the website.

PURCHASING AN ITEM

The purchase contract takes place via our online shopping cart as follows:

• The items intended for purchase are added to the shopping cart. You may select the shopping cart by clicking the appropriate field on our website.
• All prices are payable in Euro (€). Prices for items include VAT but do not include charges for shipping and handling.
• Any additional charges for shipping and handling will be displayed on the shopping basket before the submission of your order.
• After selecting the items, you must click the proceed to checkout button and enter the required information such as payment and shipping details.
• By clicking the “place order” button you will submit your order.
• We will then send an email confirming that we have received your order.

VARIOUS

In order for us to be able to execute your order you must ensure that all information provided is correct. Our effort is to accurately display the images of our items; however, we cannot guarantee that your monitor / screen will accurately display the items. We may choose to limit quantity or refuse the sale of an item to any person for any reason. 

We reserve the right to reject and/or cancel an order if:

1. we have reasonable grounds to believe that the order has been placed by a dealer and/or distributor and this has not been indicated to us; 
2. there were pricing errors or insufficient stock; 
3. we suspect criminal activity such as fraud.

RETURNS AND REFUNDS

In case you have decided to cancel your order or return an item you have bought online, you should inform us by email at [email protected]. If the item has been dispatched or if you have received the item, we will then let you know where and how to return the item bought. In the event that you do not return the item in accordance with our directions, we reserve the right to decline to proceed with a refund or a credit voucher.

Any returns should be made within 30 days from the date you received the item.

Any item returned must be unused, with tags and in its original packaging. 

If the item returned has been damaged or used, we may deduct part of the purchase price or refuse the return of the item. 

When we receive the returned item, we will inform you accordingly via email and will proceed with the refund or with a credit voucher for our store which will be valid for one year from the date it has been issued. 

You are requested to promptly check the item for completeness, visible defects and transport damage as soon as it is delivered. If you receive an item that was damaged, please contact us immediately by email at [email protected]. 

The return right is not available for items which have been manufactured specifically for a client or which have been tailored to the personal requirement of a client.

SHIPPING AND TAXES

For the Republic of Cyprus and Greece: Unless we specify otherwise, your order will be sent via ACS. 

For international deliveries: We will inform you accordingly in our confirmation email.  Shipping charges depend on the size, weight and value of the items purchased. Some items may not be available for international shipping. Specific taxes and import duties may apply for delivery to a non-EU country, which must be paid by the purchaser to the relevant authorities of the importing country and are additional to the purchase price of any items bought. Any money transfer fees (such as bank charges) will be borne by the purchaser.

COLLECTION INSTEAD OF SHIPPING

You may opt to collect the items purchased from our store during our normal working hours. 

PROMOTIONS

If we decide to make a promotion, additional terms and conditions may apply. In case there is any inconsistency between our Terms of Service and those additional terms and conditions, the additional terms and conditions will prevail.

CANCELLATION AND TERMINATION

We reserve the right to refuse service to anyone for any reason at any time. You can cancel your user account at any time by emailing us at [email protected].   

SPANOS JEWELLERY, at its sole discretion, has the right to suspend or terminate your user account and refuse any and all current or future use of the website, for any reason at any time. Such termination of the website will result in the deactivation or deletion of your user account or your access to your account.

INTELLECTUAL PROPERTY

Except where specifically stated otherwise, we are the owners or the licensee of all trade marks, copyright, database rights, patents, and other registered and unregistered intellectual property rights in our website, and in the material published in it including but not limited to the text, images graphics, sound files, animation files, video files, information, appearance, organization, layout, software, and their arrangement on our website. All such rights are reserved. Reproduction of part or all of the contents in any form is prohibited other than in accordance with the following permissions.

You may print off one copy, and download extracts, of any page(s) from our website for your personal use and you may draw the attention of others within your organization to content posted on our website. 

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our website must always be acknowledged.

You must not use any part of the content on our website for any commercial purposes without obtaining a licence to do so from us or our licensors.

Nothing contained in our website should be construed as conferring any licence or right under any intellectual property (including patents, trademarks and copyright) of SPANOS JEWELLERY or any third party.

If you breach any of these Terms of Service, your right to use our website may cease and you must, at our option, return or destroy any copies of the materials you have made.

NO WARRANTIES

The website is provided “as is,” and SPANOS JEWELLERY makes no express or implied representations or warranties, of any kind related to the website or the materials contained on the website. Additionally, nothing contained on the website shall be construed as providing consultation or advice to you.

LIMITATION OF LIABILITY

Please read this section carefully. This section limits our liability to you for issues that may arise in connection with your use of the website. 

In no event shall SPANOS JEWELLERY, or any of its subsidiaries, officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of the website, whether such liability is under contract, tort or otherwise, and SPANOS JEWELLERY including its subsidiaries, officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of the website. 

INDEMNIFICATION

You hereby agree to indemnify SPANOS JEWELLERY, to the fullest extent from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorneys’ fees) arising out of or in any way related to your breach of any of the provisions of the Terms of Service.

THIRD PARTY LINKS

The website may contain hypertext links which link you to other websites on the Internet, which are operated by parties other than SPANOS JEWELLERY.  Please ensure that you read the legal sections of any other third-party site which you may visit. These links are provided for your information only. SPANOS JEWELLERY has no control over the nature and contents of such websites and is not responsible nor it accepts any liability for any information or opinion contained in any third-party website. It is up to you to ensure and take precautions that the links that you select or software you use is free of such items as viruses, worms, trojan horses and malware. The inclusion of hypertext links to such websites does not constitute endorsement of the material on such websites and does not imply any association with their operators.

SEVERABILITY

If any of the Terms of Service including the limitation of liability is found to be illegal, invalid or unenforceable, then same will be severed from the Terms of Service which remain in full force and effect.  The invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of the Terms of Service.

ENTIRE AGREEMENT

The Terms of Service, including any legal notices and disclaimers contained on the website, constitute the entire agreement between SPANOS JEWELLERY and you in relation to your use of the website, and supersede all prior agreements and understandings with respect to the same.

APPLICABLE LAW

The Terms of Service shall be governed by the laws of the Republic of Cyprus and the Courts of the Republic of Cyprus shall have exclusive jurisdiction in relation to any disputes arising out of or in connection with the Terms of Service.
